Warning! This article contains SPOILERS for Dark Winds season 3’s finale.The ending of Dark Winds season 3 mostly put a bow on the various investigations and dramas going on, but it also ended up making one of Special Agent Sylvia Washington’s (Jenna Elfman) decisions even more confusing in retrospect. After Joe Leaphorn (Zahn McClarnon) killed BJ Vines at the end of Dark Winds season 2, Agent Washington was sent to investigate Vines’ disappearance. It immediately looked like she had figured everything out, and her investigation was a constant source of stress and pressure for Joe throughout the season. It seemed like Washington was mere moments away from cracking the case and locking Joe up.
But, at the end of Dark Winds season 3, Washington completely abandoned her investigation, and Joe walked free. She explained what happened simply enough: she just didn’t have enough evidence to prove that Joe killed BJ Vines in a court of law, even though she knew it was true. All she had was some circumstantial evidence, like a handful of witnesses who saw the make of Joe’s car, but not Joe himself. That explanation makes sense, but it didn’t explain a moment in Washington’s investigation when she had Joe dead to rights and refused to prove he was lying.

Washington Clearly Knew Emma Couldn’t Support Joe’s Alibi, Yet She Let Joe Get His Story Straight Anyway
In Dark Winds season 3, episode 4, Washington confronted Joe about one of her more incriminating bits of evidence. One of the witnesses Washington interviewed said he saw a GMC in the area on the night when BJ Vines went missing. After checking registration information, Washington determined that Joe was the only person who lost a loved one in the Drumco explosion and owned a GMC, making him the prime suspect in her case. She asked Joe if he had an alibi for the night, Joe said that he was with Emma (Deanna Allison), and Washington clearly knew it was phony.
Washington even said that she wanted to drive home with Joe and see if Emma could corroborate his alibi, but she just didn’t. If she had, Emma would likely have told the truth, that Joe wasn’t there that night, or told a different lie; either way, it would have exposed Joe and basically closed the BJ Vines case. The only explanation I could think of for why Washington didn’t take advantage of Joe’s lie was that she had some sort of ace up her sleeve and didn’t need to disprove Joe’s alibi. Dark Winds season 3’s ending, however, debunked that theory.

When Emma Supported Joe’s Alibi, Washington Had To Drop Her Entire Investigation
Confusingly enough, Agent Washington didn’t have an ace up her sleeve. As previously mentioned, her entire case was built on circumstantial evidence, and the only hope she had of arresting Joe was proving that his alibi was fake. That’s why she was so disappointed when Emma continued to support Joe. Given the importance of Joe’s alibi not checking out, it now makes no sense at all that Washington just let him get away and work out his cover story with Emma in Dark Winds season 3. There was literally no reason for her to do that, and it all comes across as a convenient “get out of jail free” card for Joe.

There are a few possible explanations for Washington’s behavior, but they don’t hold up to scrutiny. Washington might have been banking on finding some incriminating evidence at the Leaphorn house, but passing up a golden opportunity to disprove Joe’s alibi was a huge gamble she never should have taken. Alternatively, Washington may have just chosen to trust Joe out of respect for a fellow law enforcement officer, but Joe was a prime suspect at that moment, not a colleague. As of now, it looks like Agent Washington inexplicably bungled the BJ Vines investigation in tremendous fashion in Dark Winds season 3.
